Important Information to Know About Breaks
Breaks or rest periods are not authorized by federal law, state statute or administrative regulations. Therefore, granting breaks is not an employer obligation, nor receiving breaks an employee right. Employees of the department may be granted breaks or rest periods of 20 minutes per four hours of work if such periods do not disrupt the normal operation or efficiency of the employee’s work unit. Time spent on break is not cumulative, cannot be used for leaving early if not taken during the work period and is not compensable if not taken. Administrators are responsible for developing policies for the management of breaks or rest periods consistent with the function of their operations.
