DEFINITION OF WORK
Summary
This is highly specialized criminal
investigative work in the Board of Indigents' Defense
Services. Work involves performing the investigative activities
involving investigation associated with the criminal defense
of individuals accused of capital offenses or the gathering of evidence
for the prosecuting attorney on crimes that have been commented against
people or property.
Work includes contact and coordination with various law enforcement agencies,
crime witnesses, families and/or acquaintances of the accused,
victims, and court officials.

Supervision Received - LEVEL C: "Under direction
"
Employees at this level usually receive a general outline of the work to be performed and
are generally free to develop their own sequences and methods within the scope of
established policies. New, unusual, or complex work situations are almost always referred
to a superior for advice. Work is periodically checked for progress and conformance to
established policies and requirements.
Difficulty - LEVEL C: Considerable
Duties which require a
high degree of concentration because of the many factors which must be considered and
weighed before a decision can be reached. Usually positions that require planning,
developing, and coordinating programs and directing fairly large groups of people fall
into this category.
Complexity - LEVEL D: Work is of a diversified nature that usually
involves multiple unrelated steps. Analytical thought is necessary for dealing with
complex data and situations. Work often involves a variety of unrelated processes and may
require planning or carrying out a sequence of actions or both. Several alternatives
usually exist at this level for approaching problems or situations. Workers at this level
exercise a considerable amount of independent judgment. Work is controlled by occasional
review and by reporting to or consultation with supervisors or superiors. When guidelines
exist at this level, they are usually broadly defined or technical requiring careful
analysis and interpretation.
Consequence of Actions or Decisions - LEVEL D: Consequences of
actions or decisions at this level are significant as the work may be rarely if ever
reviewed, making errors difficult to detect. Errors may cause major program failure or a
high degree of confusion. Injuries to others due to errors are serious or incapacitating
or both and costs due to errors are substantial.
Contacts - LEVEL C: The purpose of the contact is to influence,
motivate, conduct interviews, make formal presentations or counsel to achieve common
understanding or solutions to problems when the information is sensitive in nature or the
individuals or groups are skeptical or uncooperative. Communication techniques and well
developed communication skills become an important requirement at this level.
Physical Demands - LEVEL B: The work requires light physical
exertion. The employee may be required to perform handling activities with lightweight or
easily moved items (e.g. books, file folders, boxes of office supplies, small machine
parts, etc.); perform moving activities for brief periods; operate light equipment;
perform repetitive motions for brief periods; confined to a work area.
Environmental Conditions - LEVEL B: The work environment involves
moderate hazards, risks or discomforts. Exposure to minor deviations from pleasant
environmental conditions is normal. Minor to serious injuries are possible.
Supervision/Leadership - LEVEL A: No supervisory or leadership
responsibility; may explain work instructions or assist in training others.
Distinguishing Features
Differs from the KBI Special Agent Class Series where work involves conducting
investigation to prevent or solve criminal cases and
crimes to document evidence for the prosecution
of a wide variety of criminal activities.
Differs from other law enforcement investigators where work involves
gathering of evidence for prosecuting or defending of individuals accused
of crimes.
EXAMPLES OF WORK PERFORMED
Initiates investigations of potential capital murder cases upon their assignment
by the capital defense chief attorney.
Initiates investigations of potential crimes and other violations
of the state or federal criminal law.
Confers with law enforcement agencies requesting investigative
assistance and evaluates the crime information reported to determine the workforce and
equipment necessary to pursue investigation.
Makes recommendations regarding the utilization of contract
investigators, and determines when an investigation should be initiated, modified or
completed.
Assigns, coordinates, reviews and evaluates criminal
investigations and surveillance conducted by contract investigators.
Plans, organizes and directs the work of technical,
paraprofessional and/or clerical personnel; establishes operational methods, procedures
and forms; develops departmental policies and regulations; prepares various statistical,
financial and special reports.
Provides necessary resources to complete timely and accurate
investigations.
Assesses personnel such as expert witnesses, equipment and other
costs necessary for operations and provides documentation to supervisor.
REQUIRED KNOWLEDGE, ABILITIES AND SKILLS
Knowledge
*Knowledge of broad application of criminal investigation
procedures and techniques and laws pertaining to evidence.
*Knowledge of federal and Kansas criminal law and its
jurisdictional aspects.
*Knowledge of computer technology or other specialize areas
required of particular assignments.
*Knowledge of English usage and written communication format.
*Knowledge of forensic, and scientific evidence.
Abilities
*Ability to establish and maintain effective internal working
relationships and with a variety of law enforcement agencies.
*Ability to effectively testify in court.
*Ability to determine the essential physical aspects of a crime
scene for diagraming and photographing purposes.
*Ability to interview and/or interrogate others to elicit
pertinent information.

*Ability to accurately recall and to verbally present information
concisely.

MINIMUM REQUIREMENTS:
Five years experience in
capital case defense work. Education may be substituted for experience as
determined relevant by the agency.
Three years experience in general law enforcement, including six
months of investigation experience. Education in criminal justice, fire
science or law enforcement may be substituted for experience as determined
relevant by the agency.
Necessary Special Requirements:
Must be a United States citizen and at least 21 years of age. Must
complete a basic law enforcement training program recognized by the Kansas
Law Enforcement Training Commission and obtain certification as a law enforcement
officer from the Kansas Law Enforcement Training Commission before being
given permanent status. At time of appointment, candidate must take and
pass a drug screening test approved by the Division of Personnel Services.
This class requires the use of a firearm for law enforcement duties and
therefore, candidates cannot have been convicted of, and must be free of
any diversions from, a felony or misdemeanor domestic violence crime as
set forth in 18 U.S.C. § 922 (d) (9) and (g) (9).
