Question: How do I appeal to the Civil Service Board? What can I appeal, how long do I have to appeal and what do I need to include in my appeal? Answer: Pursuant to K.S.A. 75-2929d and 75-2949, permanent employees in the classified service may request a hearing before the Civil Service Board to determine the reasonableness of: 1. a dismissal, demotion or suspension of the employee; 2. refusal to examine an applicant or to certify a person as eligible for a job class; and 3. disciplinary action taken in violation of K.S.A. 75-2973 and amendments thereto. Each request for a hearing before the Board must be in writing and must be received by the Director of Personnel Services within 30 calendar days of the effective date of the dismissal, demotion or suspension. While not set out in statute, there are a number of things which should be included in the employee's appeal to the Board. At a minimum, the appeal should include the employee's name, current address, the agency whose action the employee is appealing and the effective date of the disciplinary action which the employee is appealing. In addition, the Board appreciates the inclusion of a phone number at which the employee can be reached (for scheduling purposes), and the name of the employee's attorney if the employee has chosen to retain counsel for their appeal.
